Alec Baldwin wants to get rid of the special prosecutor on the 'Rust' shooting case

Soap2day – Alec Baldwin's lawyers want the special prosecutor in the "Rust" case to be kicked off the case. The 64-year-old actor is scheduled to go to court on February 24 over the death of Halyna Hutchins. However, Baldwin's lawyers have filed to have Andrea Reeb, who is both a prosecutor and a state lawmaker, removed from the case because they say it is "unconstitutional" for her to be involved.

In a motion Baldwin's lawyers filed on February 7, they said, "The Constitution says that Representative Reeb can't be both a lawmaker and a special prosecutor at the same time. Doing so would give the same person the core powers of two different branches, which is against what the New Mexico Constitution says in Article III, Section 3."

In November 2022, Reeb was chosen to be a member of the New Mexico House of Representatives. Baldwin had said before that he would "fight" the charge of manslaughter by accident. Luke Nikas of Quinn Emanuel, the actor's lawyer, also criticized the decision to charge the Hollywood star in connection with the death of cinematographer Hutchins, who was killed in October 2021 when a fake gun went off on the set of "Rust."

In a speech, he said, "This decision messes up the tragic death of Halyna Hutchins and is a terrible mistake of justice. Mr. Baldwin had no reason to think there was a real bullet in the gun or anywhere else on the movie set. He trusted the people he worked with, who told him the gun didn't have any live rounds."

Baldwin has always said that he did nothing wrong, and he wants to clear his name. His lawyer also said, "We'll fight these charges and win."
